Biography

William J. Ban, a partner in Barrack, Rodos & Bacine’s New York office, focuses his practice in the areas of securities, antitrust and consumer class action litigation.  Throughout his 40 year career, Bill has has participated as lead or co-lead counsel, on executive committees, and in significant defined roles in scores of major class action or derivative cases in federal and state courts throughout the country.  Since he came to BR&B in 2004, he has been an important member of the litigation teams that have prosecuted major class actions to their landmark conclusions.

Bill is a member of the Firm’s consumer litigation practice group, participating in important litigation on behalf of injured consumers, and the Firm’s case evaluation and client services group, analyzing the markets for emerging frauds and other corporate misbehavior on behalf of the firm’s clients.

Securities Cases
  • In re WorldCom, Inc. Securities Litigation, Master File No. 02-Civ-3288 (DLC), before the Honorable Denise L. Cote in the Southern District of New York, which yielded a record-breaking recovery of $6.19 billion for the class.
  • Pennsylvania Public School Employees’ Retirement System v. Bank of America Corp., et al., Civil Action No. 1:11-cv-733-WHP, before the Honorable William H. Pauley, III, in the United States District Court for the Southern District of New York, which settled after nearly six years of intensive litigation for $335 million.
  • Rubin v. MF Global, Ltd., et al., Case No. 1:08cv2233-VM, before the Honorable Victor Marrero in the Southern District of New York, which settled for $90 million after the Second Circuit Court of Appeals reversed the trial court’s dismissal of the complaint.
  • Shenk v. Mallinckrodt plc., et al., Civil Action No. 17-cv-00145 (DLF), before the Honorable Dabney L. Friedrich in the District of Columbia, which settled for $65.75 million notwithstanding that the company initiated proceedings in a U.S. Bankruptcy Court after the lead plaintiff had defeated a motion to dismiss and while the parties were in the midst of document discovery.
  • In re WageWorks, Inc. Securities Litigation, Case No. 4:18-cv-01523-JSW, before the Honorable Jeffrey S. White in the Northern District of California, which settled for $30 million.
Antitrust Cases
  • In re Automotive Refinishing Paint Antitrust Litigation, MDL No. 1426, before the Honorable R. Barclay Surrick in the Eastern District of Pennsylvania, achieving settlements totaling over $105 million.
  • In re: Lithium Ion Batteries Antitrust Litigation, MDL Docket No. 2420, before the Honorable Yvonne Gonzalez Rogers in the Northern District of California, which resulted in settlements totaling $139 million.
