Firm History

Since 1976, the lawyers of Barrack, Rodos & Bacine have worked tirelessly on behalf of investors in America’s capital markets – the backbone of the American economy – as well as victims of corporate price-fixing conspiracies and other unfair business practices. Using the federal securities laws, we have fought to ensure that investors who lose money on their investments because of fraudulent behavior by corporations and their managers receive compensation for their losses from the wrongdoers. When a corporation misapplies accounting principles to hide its declining performance or fraudulent activity by its management, or when corporate insiders “cash in” on inside information at the expense of the investing public, or any one of a wide variety of schemes involving “fraud,” we are there to vindicate the rights of those defrauded investors.

Securities Litigation

Throughout its history, our firm has pursued only those cases with strong allegations of wrongdoing that have withstood scrutiny under the federal securities laws, both before and after passage of the Private Securities Litigation Reform Act of 1995, commonly known as the PSLRA. The PSLRA was a turning point for securities litigation – explicitly encouraging large institutional investors to become involved in enforcing of the federal securities laws. We were the first firm to represent public pension funds as lead plaintiffs in securities class actions under the PSLRA. Beginning in the spring of 1996, we filed securities class action cases on behalf of the retirement systems of the City of Philadelphia and the Commonwealth of Pennsylvania. Building on that experience, our firm has steadily grown its institutional client base by developing an array of innovative services for institutional investors, in addition to high quality legal representation. Our institutional clients include large, mid-sized and small public pension funds in the United States and the European Union, including the United Kingdom, representing the retirement savings of public employees, including firefighters, police officers and teachers, as well as local and national labor unions. All of our clients receive the same superior legal representation and client service that courts and clients across the country have come to expect from us.

Antitrust Litigation

Since its founding, our firm has also concentrated its practice in representing, in class action litigation, individuals and businesses that have been injured as a result of antitrust price-fixing conspiracies. We have extensive experience litigating antitrust class actions and, over the years, have achieved large recoveries in cases against the manufacturers or producers of graphite electrodes, citric acid, sodium gluconate, sorbates, polypropylene and nylon carpet, metal building insulation, flat glass, automotive refinishing paint, vitamins, brand name prescription drugs, residential doors, plastic tableware, beer and copper tubing, among others.

Other Litigation

For over 30 years, our firm has also pursued a wide range of litigation on behalf of its clients. We have represented:
• consumers in actions against insurance companies, challenging unfair business practices and fraudulent annuity contracts;
• both brokers and brokerage firm clients in lawsuits and arbitrations arising from the client-broker relationship;
• minority shareholders as well as members of corporate boards in lawsuits arising from disputes over corporate control;
• shareholders derivatively seeking to hold corporate management accountable for harm they have done to the corporation; and
• shareholders whose investments in a company are threatened by inadequate takeover bids.
